The Law Under Bill C-10

Put yourself in the judge’s seat and decide whether or not you’d feel comfortable sending a person to prison in the following situations…


If you are growing six marijuana plants for your sick grandfather whose doctor refuses to sign his medical declaration then you would face a mandatory six months in jail.  (see s. 41(b)(i) of Bill C-10)

If you were the judge, would YOU send this person to jail?

 

If you have three kgs of marijuana and you have previously been convicted of a marijuana offence then you will be sentenced to one year in jail if you pass a joint of that marijuana to a friend (you are then possessing it for the purpose of trafficking).  (see s. 39(1)(a)(i)(D) of Bill C-10)

If you were the judge, would YOU send this person to jail?

 

If you are 18 years old with three kgs of marijuana and you pass a joint of that marijuana to your 17 year old friend then you will be sentenced to two years in a penitentiary.  (see s. 39(1)(a)(ii)(C) of Bill C-10)

If you were the judge, would YOU send this person to jail?

 

If you are walking home with three kgs of marijuana in your backpack and you intend to share with your girlfriend and you happen to walk by a school then you will be sentenced to two years in a penitentiary.  (see s. 39(1)(a)((ii)((A) of Bill C-10)

If you were the judge, would YOU send this person to jail?

 

If you take a couple of grams of marijuana across the border with you so that you and your travel partner have something to smoke on your holiday then you will be sentenced to one year in jail.  (see s. 40(a)(i) of Bill C-10)
